21 is a stand-up dude.

After hearing Casanova getting indicted and facing up to life in prison it reminds me how much of a stand up dude 21 is. There’s rappers copping charges left right and centre, throwing their life away, being a shitty father. Meanwhile 21 (as street-entrenched as they come) took responsibility and ownership with his life when he rose to fame, putting his family and kids first but keeping his values straight. He’s not a punk nor a hot headed idiot and although he still has street in him, he moderates it. Not to suck him off or anything but 21 is a lot smarter, and a solid dude then he gets credit for.

Mr. Hernandez, I've given it a lot of close thought, including your cooperation. The following are my thoughts, & this is going to take a little while.
You are in custody for 13 months. I agree you deserve a great deal of credit for cooperation.
However, I cannot agree with your counsel that time served it appropriate. In my judgment, your conduct is too violent and selfish to make 13 months reasonable. You will not be going free today.
For the better part of a year, you were part of a violent gang. So that there is no misunderstanding, here is a specific account of those act. First came Trippy Redd... You decided to shoot at a member of Trippy Redd's entourage
Jordan fired into the sprinter van, in the Times Square area. It is a matter of sheer luck that an innocent person or people was not wounded or killed.
When you pled guilty, you admitted to attempting to commit murder. On April 3, 2018, with a record label in Texas [Rap-a-Lot]. You drove to 40th Street and 8th Avenue. Kifano Jordan robbed the musicians at gunpoint.
You took the backpack and it was found in your home. As it happened, the musicians surrendered easily. But they might not have. Later, outside a restaurant when people yelled "F*ck 69." Jordan struck them with a firearm.
Then at the Barclays Center. You and Casanova were beefing. Your song "Billy" was a response. [Song was played at trial, half of it.] You inflamed matters by posting a video mocking Casanova
Next was Chief Keef, He was in New York, you were in LA. You offered $20,000 to shoot at Chief Keef outside W Hotel. You later gave $10,000.
Then you were in LA. A rival was live streaming in Smurf Village. Jordan offered to shoot, you said OK
In that incident in Smurf Village, a woman was shot in the foot - LL who we heard from today. Next was Snow Billy - Aaron Young shot him & I sentenced Aaron Young to 20 years.
Apart from the number and vengefulness of these attack, there's also that they were to benefit you. Before you, the gang didn't fight with rap entourages. They had no independent interest in going after musicians and their management groups
You used Nine Trey as a potent means of getting even with your rivals. You claim you "foolishly commingled with members of the gang" - but it's more than that. The attacks would not have happened without you.
Shotti said he carried an assault rifle to protect you from the beefs you started. He was recorded by Jorge Rivera saying this. You didn't shoot, but you are responsible. And so, I reject the portrait of you as a passive participant.
You told the US Probation Department you were brainwashed by the gang. That might be partially true. But the relationship was symbiotic. They got something out of it. But so did you [Engelmayer slows the words down: So. Did. You.]
Your first crime, use of a child in a sexual performance, you said the same thing, that older acquaintances were having sexual intercourse with the underaged girl. That excuse may have worked once, but it doesn't work twice
You have not been charged with using the members of the gangs as extras. You used them to much effect in GUMMO. It was your artistic license to do that. You are not being sentenced for that.
Bruce Springsteen sang about murder. You essentially joined... Your choice to join Nine Trey was unnecessary. I see a lot of gangs, like a 76 defendant Bronx case. They fell in at a young age.
That excuse is not available to you. By the time you began with Nine Trey, you were a nationally famous rapper. You had a prosperous future. Your counsel says he joined to break out of poverty. I am not buying that. You were set.
As a result of your musical career, you could have gotten the advise of security people, and presumably lawyers and accountants. I have sentenced 100s of defendants for gang activity. Your daughter had nothing to do with your decision.
But for your cooperation, you would get a very long sentence. When you began to cooperate in November 2018, some incidents the government didn't know about. But it knew about a lot. The April 3 robbery. The two April 18 shooting.
Your driver had been cooperating for many months against you... The attack on Frenchy's van was captured on security video. I therefore conclude that one way or another the full range of your conduct would have come to light.
Your cooperation was courageous. The danger to you is multiplied by your music career, which I understand you intend to continue. The fact that you are unusually recognizable does not help you.
You met with the government 26 times, reviewing social media messages and decoding them. Your cooperation enabled the government to take down a violent gang, beyond the six including you named in the initial indictment.
You testified at the trial this fall, I saw you staining to make sure you were measuring your words right. You testified in harsh glare of nationwide publicity. There were two other cooperators. But you squarely implicated the two defendants
The jury's two not guilty verdicts on firearms charged did not implicate your testimony. If have little doubt if the jury were asked if a firearm had been brandished during your kidnapping, they would have said yes. And today you apologized
I have no doubt that the process of cooperation has for you been cathartic.
For all these reasons you deserve a very substantial reduction, & you will receive you. I followed some of the commentary during the trial, I took much of it in good fun
I appreciated the memes, whether at your expense or mine. But I need to say, Nine Trey was violent, not to be glorified. Cooperation of criminal insiders is a necessary tool. Imagine the members of 9 Trey free today. There was the slashing victim
Anyone of use could have been in Times Square, or the Barclays Center, or in the street, with Kifano Jordan, or Anthony Young
You are world famous for cooperating. No gang will want to work with you. Everything I've seen suggests to me this has been a searing experience for you. You have squandered 13 months so far...
I do not expect you to be tempted to commit violence again. If you do, I am the judge in your case. And your economic self interest. You have struck a lucrative deal. The situation is unusual. You are very fortunate. You will land on your feet.
So far your story appears to prove that there is no such thing as bad publicity... In the end my judgment is that 13 months is not enough. I've considered other 5k sentences, in gang violence. 13 months is outside the mainstream.
Mr Hernandez, if you expected to be released today, you will be disappointed. But you were wise to cooperate. Your cooperation will result in years more liberty.

EARLY LIFE
Daniel Hernandez was born on May 8, 1996, in Bushwick, Brooklyn, New York City[12] to a mother from Mexico and a father from Puerto Rico.[13] His mother, Natividad Perez-Hernandez, came to the U.S. in 1988 to seek a better life and opportunity; she is also a diabetic and has had an operation on four hernias.[14] Hernandez played baseball and soccer throughout his youth, he was assigned to a major league soccer team at 13 but his mother declined because she didn’t trust a stranger taking his son at a young age.[15]

Hernandez has an older brother, Oscar Osiris Hernandez; his name is tattooed on the right side of his head.[16][17] Hernandez and his older brother Oscar were raised in a church throughout their youth. Hernandez would sing during mass and was selected many times to read the word of God, his favorite passage was Psalm 121.[18] His biological father left when Hernandez was in the 3rd grade. His stepfather was shot dead steps away from the family home in 2010.[19][20] Following the murder, Hernandez was hospitalized for depression and post-traumatic stress disorder.[21] Emotionally disturbed by the death of his stepfather, Hernandez started to act out and was eventually expelled from school in the 8th grade for bad behavior.[22] Rather than continuing his education, he started working at various jobs such as being a busboy and a delivery boy at a grocery store to help his mother financially.[23]

Hernandez also dealt drugs to supplement his income, most notably selling cannabis and heroin on the streets while working at a local Brooklyn bodega. He was eventually arrested for his criminal activities and sentenced to prison time at Rikers Island, where he began to associate himself with the Nine Trey Gangsters, a prison subset of the Bloods street gang.
Music Career
Hernandez first decided to rap in 2012 after meeting Peter "Righteous P" Rogers, CEO of New York record label Hikari-Ultra, when he came into the vegan bodega Hernandez was working at in Bushwick, Brooklyn and asked if Hernandez rapped based on his appearance, stating that he thought he had the image of a rapper and suggested that he rap because of this, along with Hernandez' cadence. [24] [25] Hernandez began releasing rap songs in 2014, starting with "69" in August 2014, "Pimpin", in September 2014, and "4769", his first collaboration as a lead artist featuring two rappers from the Brooklyn collective Pro Era, J.A.B. and Dirty Sanchez. Over the next three years, he released multiple tracks and videos with titles such as "Scumlife", "Yokai", and "Hellsing Station", drawing attention for his aggressive rapping style and use of anime as music video visuals. Many of his early songs were released by FCK THEM, a music label based in Slovakia.[26] Gathering fame as an internet meme for his rainbow-dyed hair, extensive tattoos and rainbow-plated grills, he eventually became an associate of fellow New York rapper ZillaKami, the younger half-brother of Righteous P.[27] They later feuded after Hernandez allegedly stole instrumentals and songs they had made together.[24]

Poles1469", released in April 2017, featured Hernandez alongside Trippie Redd on YouTube.[26] Hernandez rose to prominence on social media due to a July 2017 Instagram post that went viral on both Reddit and Twitter.[28] Hernandez's commercial debut single "Gummo" was released on November 10, 2017, and eventually peaked at number 12 on the US Billboard Hot 100.[29][30] It was certified platinum by the RIAA on March 5, 2018.[31] His next single, "Kooda", debuted at number 61 on the Hot 100 the week of December 23, 2017.[32] On January 14, 2018, Hernandez released his third single, "Keke", with Fetty Wap and A Boogie wit da Hoodie, which also charted on the Hot 100.[33]

Shortly afterward, Hernandez announced his debut mixtape, titled Day69.[34] The mixtape was released on February 23, 2018, and debuted at number 4 on the Billboard 200 album chart with 55,000 album-equivalent units, of which 20,000 were pure sales.[35][36] According to Jon Caramanica of The New York Times, the tape was an outgrowth of the "SoundCloud rap explosion", and was notable for its willingness to deviate from hip-hop's prevailing sound.[37] After the release of Day69, two songs from the album, "Billy" and "Rondo" both debuted on the Billboard Hot 100, with "Billy" peaking at number 50 and "Rondo" at number 73.[38][39]

In April 2018, Hernandez released "Gotti", a remix of a feature he did for artist Packman titled "Got it, Got it".[40] The song's video was released on April 16, 2018, and involved footage of Hernandez donating bundles of $100 bills to poor citizens in the Dominican Republic.[41][42] The song was added to Day69 as a deluxe song and debuted at number 99 on the Billboard Hot 100 before dropping off the following week, making it his sixth consecutive Hot 100 entry.[38]

Hernandez stirred up controversy in May 2018 when he was involved in a shooting with the entourage of fellow New York rapper Casanova as part of a feud; this led to Hernandez losing a $5 million headphone deal and being banned from the Barclays Center.[43] After the shooting, Hernandez stopped releasing music for several months, before releasing "Tati", featuring DJ Spinking in June, which debuted at number 43 on the Billboard Hot 100.[43]

In early October 2018, Hernandez was featured on the song "Aulos Reloaded" with French house DJ Vladimir Cauchemar and "Kick" with Danish singer Jimilian.[48] On November 7, 2018, it was announced that his debut studio album, Dummy Boy, was to be released on November 23,[49] but on November 21, it was announced that the album would be postponed.[50] The album was ultimately released without notice on November 27, on all streaming services.[51] Despite generally negative critical reception, the album became his highest-charting, after debuting at number two on the Billboard 200 behind Travis Scott's Astroworld.[51][52] While in jail, 6ix9ine was featured on previous collaborator A Boogie wit da Hoodie's song "Swervin", peaking at number 27 on the Hot 100, off his sophomore album Hoodie SZN. The song was released on December 21, 2018, alongside the album.[53]
